Terms of Service

These Terms of Service (“Terms”) govern your use of the Blexor platform — the websites at getblexor.com, the Blexor rider and driver mobile apps, and any related services (collectively, the “Service”) — operated by Blexor LLC (“Blexor”, “we”, or “us”). By creating a Blexor account or using the Service, you agree to these Terms.

1. What Blexor is

Blexor operates a marketplace that connects riders with independent third-party drivers (“Drivers”) for premium ground transportation. Drivers are not employees of Blexor; they are independent contractors who set their own bid prices for trips. Blexor is not a transportation provider.

2. Eligibility

To use the Service as a rider, you must be at least 18 years old and able to enter into a binding contract. To use the Service as a Driver, you must additionally hold a valid driver's license, meet our background check requirements, maintain valid vehicle registration and insurance, and operate a vehicle that meets our published vehicle standards.

3. The bidding marketplace

Riders request trips through the Blexor app. Drivers within range may submit bids specifying the price they are willing to accept for the trip. Riders choose among available bids. Once a rider accepts a bid:

• The trip price is fixed at the accepted bid amount.
• Blexor charges the rider the bid amount plus a flat 15% platform fee plus any applicable taxes and tolls.
• The Driver receives the bid amount minus the 15% platform fee.
• Tips are optional, post-ride, and paid in full to the Driver; Blexor does not retain any portion of any tip.

4. Payments

Payments are processed by Stripe, Inc. By using the Service, you authorize Blexor and Stripe to charge your designated payment method for ride amounts, fees, taxes, tolls, tips, and any cancellation or damage fees that apply under these Terms. You are responsible for keeping your payment method current and accurate.

5. Cancellations

Riders may cancel a confirmed trip without charge during a short grace window after acceptance. Cancellations after the grace window — or after a Driver has begun travel toward the pickup — may incur a cancellation fee, which is paid to the Driver. Specific grace window and fee amounts are disclosed in the app at the time of cancellation.

6. Conduct

You agree not to:

• Use the Service for any unlawful purpose.
• Harass, threaten, discriminate against, or harm any other user, Driver, rider, or Blexor employee.
• Damage vehicles, leave hazardous items, or transport unaccompanied minors without prior arrangement.
• Attempt to circumvent the bidding marketplace or arrange off-app payment for trips initiated through the Service.
• Reverse engineer, scrape, or interfere with the technical operation of the Service.

We may suspend or terminate accounts that violate these rules, with or without notice depending on the severity.

7. Driver-specific terms

If you operate as a Driver, you additionally agree that you are an independent contractor; you are responsible for your own taxes, insurance beyond any platform-provided coverage, vehicle maintenance, and compliance with local transportation regulations. You agree to keep your background check, license, registration, and insurance information current.

8. Intellectual property

The Service, including its software, branding, and content, is owned by Blexor and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. All other rights are reserved.

9. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that any specific Driver will accept a trip request, that bids will fall within any particular price range, or that the Service will be uninterrupted.

10. Limitation of liability

To the maximum extent permitted by law, Blexor will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the total amount you paid to Blexor in the 12 months preceding the claim, or (b) one hundred U.S. dollars.

11. Indemnification

You agree to indemnify and hold harmless Blexor, its affiliates, and their respective officers, directors, employees, and agents from any claim, demand, loss, or damages, including reasonable attorney's fees, arising out of your use of the Service or your breach of these Terms.

12. Dispute resolution

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered in Atlanta, Georgia, under the rules of the American Arbitration Association. You waive any right to participate in a class or representative action. Either party may seek injunctive relief in court for intellectual property infringement or unauthorized use of the Service.

13. Changes to these Terms

We may revise these Terms from time to time. If we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Continued use of the Service after changes take effect means you accept the revised Terms.
